Half-boarding a horse can be a great decision, both for you and your horse. If you need a little help paying board or feel that your horse isn’t getting an adequate amount of exercise, then you may want to consider finding a half-boarder, also known as a half-leaser or share boarder. A half-boarder is exactly what it sounds like… the person signs an agreement to pay half of whatever the cost of board is (as well as things such as farrier and vet bills if you so choose) in exchange for riding time. However, it’s important to keep in mind several issues that can arise with half-boarding and what to do in those situations.

Who Will Pay the Horse’s Maintenance Fees?
In these arrangements, you may also want to ask your half boarder to pay half for extra expenses. These expenses include hoof trimming and shoeing, routine veterinary bills, and de-worming costs.

What Happens if the Horse Requires Major Veterinary Care?
The possibility always exists that an emergency will arise, which can become expensive. For example, the horse might experience a severe cut during a trail ride with your half-boarder, who will pay the vet bill? It’s important to address this issue in advance.

What if Somebody Gets Hurt?
Included in the contract should be what will happen if the half-boarder becomes injured while riding your horse.

Are There Restrictions on the Use of the Horse?
You should specify how many days of week the horse can be ridden and what days of the week. You should also specify in writing whether or not the horse can be taken off the property for shows or trail rides as well as the limits of the horse (jumping without a trainer present, duration of the ride, etc.)

This should all be put in writing and signed by both parties before pursuing with the half-board agreement. Find a lawyer experienced in equine law to ensure that you have included everything and that it will withstand if anything were to go wrong with the half-lease agreement.

Oftentimes, people find themselves in disputes with the contractor for a variety of reasons – typically a disagreement regarding the contract. Below are the steps to take if you find yourself in the midst of a contractor dispute.

Contact the Contractor
Before pursuing anything, it’s important to always report the problem directly to the contractor to give him or her an opportunity to fix it. Be sure to report the problem as clearly as possible in writing.

Mediate
If the contractor refuses to fix the problem and ignores your request to do so, it may be time to contact a civil litigation lawyer in California. A civil litigation lawyer will be able to help solve the issue, preferably without trial. Catanese & Wells’ goal is to resolve the case quickly and avoid trial, through mediation or arbitration. If a trial becomes necessary, the team will work to conclude as quickly as possible in your favor. Mediation can help save you time and money, as well as any extra hassle. Your civil litigation lawyer in California will do whatever it takes to help you and can explain the process to you so you know exactly what is going on at all times.

If you are unable to settle, Catanese & Wells will do everything they can to help prevent financial loss and ensure that the correct legal actions are taken. In the case where you are unable to reach an agreement, you should speak to your lawyer about having someone else finish the work. It’s important to hire a lawyer experienced in civil litigation and contractor disputes in order to solve the case quickly and efficiently.

A probate attorney plays an important part in planning an estate. Engaging in estate planning is one of the best gifts you can give your family. If you haven’t executed a Will, now is the time to do so. Since we never know when something can happen to us, the sooner you prepare, the better. Hiring a probate attorney can bring you peace of mind knowing that everything is in order in the event of your passing.

Probate is required within each of the 50 states unless you establish a revocable or irrevocable trust. In order to validate ones’ last will and testament, estate settlement, and distribution of inheritance assets to the designated heirs, a probate process (and therefore, probate attorney) is required. In order to manage estate planning, most people choose to hire a California probate attorney, as the process can become complicated and somewhat confusing. California probate attorneys can aid in executing a last will, designating the power of attorney rights, establishing healthcare directives, and providing guidance during the probate process. Due to the complexity of California probate laws, few people can administer estates without legal representation and the decedent’s last will and testament needs to be validated through court.

If you pass away without a legal will, your family will end up suffering a long and confusing process, as there are additional steps required when there is no will. This can end up causing disputes between family members over your assets, which makes things harder on everyone upon your passing. In order to spare a potential messy dispute and have the peace of mind that your assets will be distributed properly, it’s important to hire a probate attorney to aid in creating a last will.

A confidentiality agreement, also known as a nondisclosure agreement (NDA) is an agreement contract that takes place between two or more people. It is written and specifies the terms of the agreement, why they are put into place, and both parties agree not to discuss the matter with anyone outside of the agreement. A typical confidentiality agreement may be between an employer and an employee when the work being performed is confidential.

If you know that you need a confidentiality agreement, it’s important to contact a California business lawyer, as some agreements can become complicated. Business lawyers have experience in drafting confidentiality agreements and can ensure that yours is up to par. When drafting your agreement, you need to give as much information and detail as possible including what must remain confidential – this should include all letters drafted, content of phone calls, and work product. Your California business lawyer will make sure that the obligations are easy to read so that the agreement is completely understood by both parties. You must also state what is not confidential and be specific to reduce any chance of misunderstandings between any party to the agreement.

There should be a start and end date included in the agreement and it’s important to make the consequences known for failure to abide by obligations of the agreement – for example, consequences may be termination or paying monetary damages. These are just a few things to think about, as your experienced attorney will help you write your confidentiality agreement to make it easy to be understood by all parties involved.

When facing a partnership or shareholder dispute, it’s important to solve the dispute as quickly and discreetly as possible to avoid or minimize your losses. Disputes can also disrupt business operations, so it’s also important to solve this dispute to keep things running smoothly and let the parties involved get back to business. There are many reasons that a shareholder or partnership dispute can arise, including salary issues, unfair termination, mismanagement, fraud, breach of contract, missing funds, future business plans, division of work, withholding information, or determining the fair value of one’s shares.

Oftentimes disputes occur because it is unclear of how they will define how the business will treat shares if someone who is invested leaves the business, dies, becomes disabled, or files for bankruptcy or divorce. If you do not clearly outline how each one of these situations will be handled, it can lead to a dispute between partners and shareholders… which is why it’s very important to outline these situations before they have a chance to occur.

When a dispute such as listed above arises, you should contact a civil litigation lawyer in California as quickly as possible – the sooner you contact a lawyer, the more quickly and effortlessly things will get solved. Catanese & Wells is dedicated to providing you with the civil litigation knowledgeable and experience lawyers you deserve. Their goal is to resolve the case quickly and avoid trial, through mediation or arbitration. If a trial becomes necessary, the team will work to conclude as quickly as possible in your favor.

It’s incredibly important to have a pre-purchase exam performed when buying a horse, regardless of your familiarity with the horse or seller. A pre-purchase exam will provide you with a complete understanding of the health of the horse before you put money into the animal. Unfortunately, it’s not uncommon for horses to be drugged or for other frauds to be committed within the horse industry. Choose a vet that does not have a relationship with the seller and be wary of a seller who discourages you from having a pre-purchase exam or using a veterinarian of your choice. Below are more tips for a pre-purchase exam and can help prevent litigation in the long run.

If you are buying a horse out of area, try to avoid asking the seller for a recommendation, as the veterinarian may have a biased opinion if they have a business relationship. Instead, ask for a list of veterinarians and choose one from the list.

If you’re selling a horse, you should not allow a buyer to take a horse off your property for a pre-purchase exam. Instead, the seller should be the one to bring the vet to the exam if the vet will not make a barn call.

Pre-purchase exams should always be done prior to the purchase. The exam should be done before the byer takes possession of the horse, the buyer pays for the horse, and before the buyer receives a bill of sale from the seller.

Sellers should encourage buyers to get a complete pre-purchase exam and to inspect horses before the purchase or delivery of the horse, as it protects both parties: buyer and seller.

If the horse has had a pre-purchase exam prior to the seller’s purchase, the buyer should ask for a copy of the result from the exam.

If you’re unsure of the specific aspects regarding equine law and pre-purchase exam, contact an equine lawyer to ensure that you are aware of all of the horse’s health problems, if any.

When you are in business with a partner(s), it’s important to write a buy/sell agreement to protect all the partners involved by writing guidelines for selling the business shares. This also protects the interest of the business. The buy/sell agreement will dictate when shares can be sold, for how much, and in what manner. This agreement will protect the business and its assets in the case of a divorce, death, bankruptcy, or the end of a partnership. These are all reasons why it’s so important to sit down with your business partner(s) and a California business lawyer to formulate a buy/sell agreement just in case.

When writing a buy/sell agreement, you must decide how to handle the selling of shares by a partner in the case of a break in partnership. It’s also very important to establish a plan in the case of a divorce. For example, if one partner gets divorced, will his former spouse be required to sell any shares received in the divorce back to the other partner(s)? You may also want to consider what to do in the case of a death of a partner as well as a partner’s personal bankruptcy. While these are not pleasant things to think about, these are all things that are important to consider in order for your business to succeed.

Contact an experienced California business lawyer to determine exactly what you want to touch upon in your buy/sell agreement and to make sure everything is included. Catanese & Wells is a business lawyer with over 30 years of experience in business litigation. It’s important to choose a lawyer who will consider your business’ specific needs and has your best interest in mind while helping you write your buy/sell agreement.

When you find yourself in a business dispute, whether with a partner, client, or employees, it’s important to hire an experienced and professional California business litigation lawyer. A good civil litigation lawyer will aim for the early settlement of a case in order to save you time, money, and stress but is willing to deliver a superior litigation effort if settlement is not practical. Their main goal should be to resolve the case quickly and efficiently while avoiding trial, through mediation or arbitration.

It’s important to hire a lawyer who is experienced and has been in the field for a long time in order to get the best end results in your favor. A lawyer should always take your case and evaluate it individually to ensure the correct actions are taken and to help you avoid unnecessary losses. A great California business litigation lawyer will understand the law and do their best to help you understand the process. Law can be confusing and often can be difficult to understand, even in the simplest terms and it’s their job to guide you through the process to give you the best understanding possible.

Unfortunately landlord and tenant disputes are all too common and simply come with the territory of renting property, whether it’s land, a house, or an apartment. Disagreements occur fairly regularly among landlord and tenants over many different aspects such as rules and regulations, rent increases, responsibility for repairs, security deposits, and early termination of the lease. Trying to resolve the disagreement between the parties should be the first choice. However in some instances, you may need to hire a civil litigation lawyer in California

As a tenant, you can avoid disputes with your landlord by having a good written lease agreement in place and by simply knowing your rights. Take an hour or so and educate yourself on the basics of your rights under federal, state, and local law when it comes to renting. It’s important to always retain copies of any correspondence in case they must be used as evidence, as well as receipt for repairs, photos, or reports. Most landlords are reasonable who try to make everything fair but if you feel like your landlord is being un reasonable and is doing something illegal, it may be time to contact a civil litigation lawyer to see how they can help you settle the dispute.

Catanese & Wells is an experienced civil litigation lawyer in California that helps to solve a variety of disputes, including commercial, business, partnership corporate, real estate, and more. Our goal is to resolve the case quickly and avoid trial, through mediation or arbitration in order to help you prevent financial loss and achieving a solution quickly and efficiently.

Oftentimes, horse owners who don’t own trailers will allow a friend or will pay someone to trailer to a show, trail ride, or another activity off the farm. Whether it’s a friend, family member, or professional horse transporter, few equestrians stop to consider who would be responsible if an accident were to occur while trailering resulting in the horse’s injury or death. When an accident occurs, it is rare that the driver’s insurance policy will adequately cover your loss or indemnify you if your horse is injured or killed, causes harm to another person, or causes harm to property due to the accident. Auto insurance typically does not cover a horse trailer without an additional rider to the policy and also typically excludes coverage for anything inside the trailer, including the horse(s).

If your horse in inadequately insured, your only option in the event of your horse’s death or injury due to a trailering accident is to sue the party who is responsible for the damages. If your horse is valuable, you may want to look into insuring him or her for major medical/mortality insurance, as well as risk of loss to ensure their damages are adequately covered. However, according to equine law, if the horse was negligently or improperly loaded and results in damage to a person or property, the horse owner may be found liable. If this were to happen, a horse owner’s liability policy would provide adequate protection in the event of a lawsuit.

The best way to avoid costly litigation and enjoy the benefits of someone else trailering your horse is to ensure that you, as the owner, have adequately insured both yourself and the horse.
